Terms of Service

Agreement to Terms

By accessing or using ΩZARK trading indicators ("Products") provided by GROW RIIOT LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our Products.

Use License

Upon purchase, we grant you a limited, non-exclusive, non-transferable license to:

  • Use the Products for your personal trading analysis
  • Install and run indicators on your TradingView account
  • Access updates and support during your active subscription period

You may NOT:

  • Redistribute, resell, or share the Products with others
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Products for commercial purposes beyond personal trading
  • Modify and redistribute the Products as your own
  • Share access credentials or subscription benefits

Third-Party Platforms

Our Products may integrate with or be used on third-party platforms (for example, TradingView). We are not affiliated with, endorsed by, or sponsored by any third-party platform unless explicitly stated.

You are responsible for complying with any third-party platform terms, rules, and limitations (including account requirements and subscription tiers). We are not responsible for outages, changes, restrictions, or policy enforcement by third-party platforms.

Intellectual Property

All Products, including but not limited to Pine Script code, documentation, graphics, and branding, are the exclusive property of GROW RIIOT LLC and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.

Age Requirement

You must be at least 18 years of age to use our Products. By using our Products, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Risk Disclaimer

Trading financial instruments involves substantial risk of loss. By using ΩZARK Products, you acknowledge and agree that:

  • Past performance is not indicative of future results
  • These indicators are tools for analysis only and do not constitute financial, investment, or trading advice
  • You are solely responsible for your trading decisions and any losses incurred
  • You will never trade with money you cannot afford to lose
  • GROW RIIOT LLC is not liable for any trading losses, damages, or financial consequences
  • You should consult a qualified financial advisor before making investment decisions
  • Trading can result in the loss of your entire investment

No Investment Advice / No Guaranteed Results

We are not a broker-dealer, registered investment adviser, or financial advisor. Nothing on our website or within our Products is intended to be, or should be construed as, financial advice, investment advice, trading advice, or a recommendation to buy or sell any security or financial instrument.

We do not guarantee profits, performance, accuracy, or specific outcomes. Signals, alerts, and analytics are informational only and may be delayed, incomplete, or inaccurate.

No Warranty

Products are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Products will be error-free, uninterrupted, or meet your specific requirements. We are not responsible for any losses or damages resulting from the use or inability to use our Products.

Indemnification

You agree to indemnify, defend, and hold harmless GROW RIIOT LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of or access to the Products; (b) your violation of any term of these Terms; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of the Products caused damage to a third party.

Limitation of Liability

To the maximum extent permitted by law, GROW RIIOT LLC and its operators, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Products.

In no event shall GROW RIIOT LLC's total liability to you for all damages exceed the amount you paid to GROW RIIOT LLC in the twelve (12) months preceding the claim, or $100, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your TradingView account meets minimum requirements

Termination

We reserve the right to terminate or suspend your access to Products immediately, without prior notice, for any breach of these Terms, including but not limited to unauthorized sharing, reverse engineering, or violation of intellectual property rights. Upon termination, your right to use the Products will cease immediately.

Payment Terms

By purchasing Products, you agree to:

  • Pay all fees associated with your subscription
  • Automatic renewal of subscriptions unless cancelled
  • No refunds as per our Refund Policy
  • Price changes with 30 days notice for existing subscribers

Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website. Continued use of Products after changes constitutes acceptance of the new Terms.

Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Products shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its applicable rules (including, if you are an individual consumer, the AAA Consumer Arbitration Rules; otherwise the AAA Commercial Arbitration Rules). The arbitration shall be conducted in Arizona, United States, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Small Claims Exception: Either party may bring an individual action in small claims court in Arizona, if eligible, instead of arbitration.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Jury Trial Waiver: You waive any right to a jury trial in connection with any dispute arising from these Terms or the Products.

Exceptions: Nothing in this section shall prevent either party from seeking injunctive relief in any court of competent jurisdiction to prevent irreparable harm or to enforce intellectual property rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States of America, without regard to conflict of law provisions. To the extent any dispute is permitted to be brought in court (including to enforce an arbitration award or to seek injunctive relief), you agree to exclusive jurisdiction and venue in the state and federal courts located in Arizona, and you waive any objection to venue in Arizona.

Force Majeure

GROW RIIOT LLC shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, internet outage, power outage, or other cause which is beyond GROW RIIOT LLC's reasonable control.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and GROW RIIOT LLC regarding the use of the Products and supersede all prior or contemporaneous communications, proposals, and agreements between you and GROW RIIOT LLC.
